Terms of Service

1. About Uploader

Uploader (the "App") is an internal web application operated by Maneks Plus d.o.o. ("we", "us", "our") at uploader.maneks.eu. The App is used by our team to build and manage Google Ads campaigns for the Google Ads accounts we own or are authorised to manage, and to upload videos to YouTube channels we own or are authorised to manage. The App is not available for public sign-up. By accessing or using the App you agree to these Terms of Service ("Terms").

2. Eligibility

You must have an account created by an authorised administrator of the App. You must be 18 years or older. By using the App you represent that you have the right to advertise the products and upload any video content you submit through it, and that doing so does not infringe any third-party rights.

3. Google API Services

The App uses Google API Services — the Google Ads API, YouTube API Services, and the Google Drive API (read-only). By using the App you agree to be bound by the YouTube Terms of Service and acknowledge Google's Privacy Policy. The App's use of information received from Google APIs adheres to the Google API Services User Data Policy. You may revoke the App's access to your Google account at any time at myaccount.google.com/permissions.

4. Permitted use

You may use the App only to manage Google Ads campaigns in accounts you own or are an authorised manager of, and to upload videos to YouTube channels you own or are an authorised manager of. You may not use the App:

  • To create advertising that violates Google Ads policies, or to upload content that violates the YouTube Community Guidelines, copyright law, or any applicable law;
  • To advertise on, or upload to, accounts or channels you are not authorised to manage, or to impersonate another person, business or channel;
  • To circumvent Google's API quotas, rate limits, or abuse-detection systems;
  • To distribute, sublicense, or resell access to the App or to the Google API data it handles.

5. Your content

You retain ownership of the products, assets and video content you provide through the App. You grant us only the technical permissions necessary to build campaigns in your selected Google Ads account(s) and to upload to your selected YouTube channel(s) on your behalf, and to store related data as described in our Privacy Policy. We do not claim any rights to your content.

6. Account responsibility

You are responsible for keeping your login credentials confidential and for all activity that occurs under your account, including the campaigns it creates. Notify an administrator immediately if you suspect unauthorised access. Campaigns created by the App are paused by default; enabling a campaign so it serves is a human decision and your responsibility.

7. Service availability

The App is provided on an "as-is" and "as-available" basis. We do not guarantee uninterrupted availability and may modify, suspend, or discontinue the App at any time without notice.

8. Disclaimer of warranties

To the maximum extent permitted by law, the App is provided without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be error-free, that defects will be corrected, or that the App will meet your requirements.

9. Limitation of liability

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of the App, including any advertising spend resulting from campaigns created or enabled. Our total liability for any claim arising out of these Terms is limited to the amount you have paid us, if any, in the twelve months preceding the claim.

10. Termination

We may suspend or terminate your access to the App at any time, with or without cause and with or without notice. Upon termination, your right to use the App ceases immediately. Sections 5, 8, 9, and 11 survive termination.

11. Governing law

These Terms are governed by the laws of the Republic of Slovenia, without regard to its conflict-of-laws principles. Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of the competent courts in Slovenia.

12. Changes

We may revise these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the App after a change constitutes acceptance of the revised Terms.
